Ryanair Faces €256 Million Penalty from Italian Competition Authority
The Italian antitrust authority, known as AGCM, has levied a hefty fine of €255.7 million against Ryanair. This penalty stems from what the agency considers abusive practices that limit the ability of travel agents to market and sell the airline’s services effectively.
Background of the Case
The ruling is a result of a complaint filed by eDreams, a Barcelona-based online travel agency, alongside two organizations that represent European travel agents and distributors. Their claim highlights how Ryanair has allegedly exploited its dominant market position, which the AGCM estimates to be around 38-40% for flights to and from Italy.
Impact on Travel Agents
According to the authorities, Ryanair’s practices have either obstructed or complicated access for online travel agents, making it challenging for them to offer Ryanair flights alongside services from other carriers. Additionally, the AGCM found that the airline pressured some travel agents into unfair distribution agreements, significantly limiting their ability to combine Ryanair flights with other travel options.
Timeline of Practices
The scrutiny of Ryanair’s actions spans from April 2023 to April 2024.
Ryanair’s Response
Ryanair has publicly criticized the AGCM’s decision, labeling it “legally flawed” and indicating that it plans to appeal. The airline pointed out that the competition authority did not consider a previous decision made by a Milan court in January 2024, which supported Ryanair’s practices as beneficial for consumers.
Clarification of Market Position
Ryanair further contends that the actual market share it holds is less than reported in the ruling, as it omits long-haul travel and other competing transportation options. The airline also defended its ‘Travel Agent Direct’ scheme, which allows third-party distributors to sell Ryanair tickets, provided they don’t mark up the prices.
